1. Acceptance of Terms
By downloading, installing, or using the Pinewood Racing application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of the App, including race organizers (Admin users) and participants (Racer users).
2. Description of Service
Pinewood Racing is a race management application for Pinewood Derby events. The App provides tools for managing racers, running heats, scoring, and broadcasting live race data. The App is developed and maintained by AppsentMind.
Certain features require an active subscription (Pro Motion and/or Live Racing). Subscriptions are offered on an annual basis through the Apple App Store.
3. User Accounts and Racer Profiles
Racer profiles, including names, photos, and Racer ID numbers (PW-XXXXXX), are stored locally on your device and optionally published to AppsentMind servers for use across events. By publishing a racer profile, you consent to that data being stored on AppsentMind servers and accessible by race organizers who look up the Racer ID.
You are responsible for ensuring that any photo uploaded as part of a racer profile is appropriate and that you have the right to use it.
4. Subscriptions and Billing
Pro Motion and Live Racing are optional annual subscriptions offered at $6.99 per year each. The Race Day Bundle (both features) is available at $9.99 per year. Prices are in USD and may vary by region.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. No refunds are provided for partial subscription periods.
A free Demo Mode is available to trial premium features for a limited time per session, subject to cooldown periods.
5. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App to upload or transmit unlawful, offensive, or inappropriate content
- Attempt to circumvent subscription restrictions or premium feature gates
- Reverse engineer, decompile, or modify the App
- Use the App in any way that could damage, disable, or impair AppsentMind's services
- Upload photos of individuals without their consent
6. DerbyCast and Live Data
DerbyCast broadcasts race data in real time via Firebase Realtime Database. Race data shared via DerbyCast — including racer names, heat schedules, and scores — is transmitted to and stored on third-party servers (Firebase/Google). By enabling DerbyCast, the race organizer consents to this data transmission.
DerbyCast data is accessible to anyone with the event code. Race organizers are responsible for the appropriate distribution of event codes.
7. Intellectual Property
The App, including its design, code, graphics, and content, is owned by AppsentMind and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Disclaimers
The App is provided "as is" without warranty of any kind. AppsentMind does not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
Race results, placements, and scores generated by the App are tools to assist race organizers. AppsentMind is not responsible for disputes arising from race results.
9. Limitation of Liability
To the fullest extent permitted by law, AppsentMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if AppsentMind has been advised of the possibility of such damages.
10. Changes to Terms
AppsentMind reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms.
